Former Finegan Dealer Group employee alleges he was wrongfully terminated because of his disability

FRESNO – An auto technician who suffers from complex partial epilepsy alleges that he was terminated by his Clovis employer because of his disability.

Joshua Spengeman filed a complaint on June 14 in the Fresno County Superior Court against Finegan Dealer Group and Does 1-50 alleging that they violated the Fair Employment Housing Act.

According to the complaint, the plaintiff was hired by the defendant in December 2015 as an auto technician in Clovis. He alleges he had a seizure at work in October 2016 and that his employment was terminated the next month.

The plaintiff holds Finegan Dealer Group and Does 1-50 responsible because the defendants allegedly failed to provide reasonable accommodation, subjected plaintiff to adverse treatment and unwarranted criticism and terminated his employment because of his disability and/or perceived disability.

The plaintiff seeks reinstatement to the same job; award for compensatory, punitive and special damages; attorney fees and costs and all further relief as the court may deem proper.
