Man alleges he was injured by driver at restaurant and again by American Ambulance employees

FRESNO – A man alleges he was injured when the restaurant where he was dining was struck by a vehicle and again when the gurney he was strapped to was dropped.

Brian Smead and Kelly Smead filed a complaint on June 16 in the Fresno County Superior Court against Elizabeth Jane Reis; K.W.P.H. Enterprises, doing business as American Ambulance; and Does 1-10 alleging negligence, loss of consortium and negligent infliction of emotional distress.

According to the complaint, on March 17, Brian Smead was dining at a restaurant in Clovis when the building was struck by Reis, injuring him. The suit states that when K.W.P.H. provided him emergency medical care, it caused plaintiff and the gurney he was strapped to to fall to the ground, causing more injuries.

Plaintiff Kelly Smead alleges she has been deprived of the consortium of her spouse. 

The plaintiffs holds Reis, K.W.P.H. Enterprises and Does 1-10 responsible because defendant Reis allegedly negligently operated her vehicle and defendant K.W.P.H. Enterprises allegedly failed to exercise the proper degree of knowledge and skill in transporting Brian Smead.

The plaintiffs seek general and special damages, incidental expenses, costs of suit and all further relief as the court deems proper. They are represented by G. William Hess of Law Offices of G. William Hess in Fresno.
