Little Tikes manufacturer alleges Giantex copied two products

SACRAMENTO – The owner of the Little Tikes trademark alleges that an Ontario company is actively and intentionally manufacturing similar products to confuse purchasers.

MGA Entertainment Inc. filed a complaint on June 23 in the U.S. District Court for the Eastern District of California against Giantex Inc. and Does 1-10 alleging false designation of origin, false or misleading description, unfair competition and other counts.

According to the complaint, the plaintiff alleges that the defendant has copied its Jump 'n Slide Bouncer and trampoline with enclosure. It alleges that it has and continues to suffer damages.

The plaintiff requests a trial by jury and seeks preliminary and permanent injunction restraining defendants to sell any products similar to the plaintiff's, monetary judgment, reasonable attorney's fees, cost of the action and such further relief as the court may deem just and proper. It is represented by Benjamin C. Johnson of MGA Entertainment Inc. in Van Nuys.
