SAN FRANCISCO – A Stockton tire and wheel distributor is alleged to have failed to pay for products it ordered.
Linglong Americas Inc. filed a complaint on July 5 in the U.S. District Court for the Eastern District of California against Get It on Wheels Inc., doing business as Tire & Wheel Outlet, and Does 1-5 alleging breach of contract.
According to the complaint, the plaintiff alleges that it sold $857,861.92 worth of tires to the defendant between April 2016 and June 2016. The plaintiff holds Get it on Wheels Inc. and Does 1-5 responsible because the defendants allegedly accepted deliveries from the plaintiff but failed to pay their invoices in full.
The plaintiff requests a trial by jury and seeks compensatory damages, $768,800.92, interest, all legal fees and any other relief as the court deems just. It is represented by Alexander M. Medina and Timothy B. Nelson of Medina McKelvey LLP in Roseville.
