Consumer accuses Total Merchant Services of making annoying, harassing calls

OAKLAND – A Woodland Hills corporation that offers payment technologies for businesses is alleged to have unlawfully called him for solicitation purposes.

Sidney Naiman filed a complaint on behalf of all others similarly situated on July 5 in the U.S. District Court for the Northern District of California, Oakland Division against Total Merchant Services Inc. alleging violation of the Telephone Consumer Protection Act. 

According to the complaint, the plaintiff alleges that in June, the defendant called him with a pre-recorded message to sell credit card processing services. The plaintiff alleges he has never been a customer of the defendant or interesting in becoming one.

The plaintiff holds Total Merchant Services Inc. responsible because the defendant allegedly violated his privacy and subjected him to annoying and harassing calls.

The plaintiff requests a trial by jury and seeks enjoin the defendant, damages, all legal fees and any other relief as the court deems just. He is represented by Edward A. Broderick and Anthony I. Paronich of Broderick & Paronich PC in Boston, Massachusetts.
