Policy holder accuses North American Life of violating ERISA

SAN FRANCISCO — An insurance policy holder is suing North America Life, alleging breach of contract.

Julie Childers filed a complaint July 5 in U.S. District Court for the Northern District of California against Life Insurance Company of North America, alleging the firm denied her claim for disability benefits.

According to the complaint, Childers suffered monetary damages from being denied payment for her disability benefits after she became unable to work Nov. 14, 2014 due to medical conditions. The plaintiff alleges the defendant refused to pay her benefits despite having sufficient medical proof to support Childers' claim.

Childers seeks future LWOP benefits under the terms of the plan, all legal fees, interest and all other relief the court deems just. She is represented by attorneys Brian H. Kim, James P. Keenley and Emily A. Bolt of Bolt Kennley Kim LLP in Berkeley, California.
