Customer alleges North American Life violated ERISA

LOS ANGELES — An insurance customer is suing North America Life, alleging breach of contract and violating the Employee Retirement Income Security Act.

Maria DaSilva filed a complaint July 13, in the U.S. District Court for the Central District of California against Life Insurance Company of North America, alleging the insurance firm wrongfully denied the plaintiff's claim for disability benefits.

According to the complaint, DaSilva suffered monetary damages from having her benefits denied. She alleges the defendant wrongfully upheld its decision to deny Dasilva's long-term disability benefits despite her being disabled according to the terms of the plan.

DaSilva seeks benefits not paid, plus interest, all legal fees and all other relief the court deems just. She is represented by attorney Phillip S. Bather of Darras Law in Ontario, California.
