Domino's Pizza store operators allege commercial property operators breached lease

FRESNO — A Domino's Pizza store operator are Fresno commercial property operators, alleging breach of lease and warranty of suitability.

E.M. Pizza Inc. and Does 1-10 filed a complaint June 27 in Fresno County Superior Court against Mercy Properties LP, Chris Mathys and Does 1-10, alleging they failed to perform their obligations under the contract.

According to the complaint, the plaintiffs were subjected to repeated interruptions in its business operations on Shaw Avenue in Fresno and were forced to expend time and resources in addressing false complaints. The plaintiffs allege the defendants failed to provide a quiet environment and refused to provide adequate air conditioning systems and sufficient lighting in the parking lot.

The plaintiffs seek trial by jury, damages of at least $25,000, punitive damages, attorney fees, costs, interest and all other just and proper relief. They are represented by attorneys Anthony DiMonte and Charles Ferrari of Adli Law Group PC in Los Angeles.
