Caregiver alleges former employers failed to pay proper wages

FRESNO — A Fresno caregiver is suing her former employers, alleging unlawful and unfair business practices.

Cheryl Bubenik filed a complaint June 28 in Fresno County Superior Court against Rowland Richard Evans, trustee of Lavetta Evans and Does 1-25, alleging they violated the California Labor Code.

According to the complaint, in July 2014 Bubenik was hired by Rowland Evans to work as a caregiver for his mother, Laretta Evans.  Bubenik alleges she has been damaged monetarily for working without proper compensation. 

The plaintiff alleges the defendants failed to pay minimum and overtime wages, failed to timely pay wages, failed to provide meal breaks and rest periods and failed to pay wages earned upon discharge.

Bubenik seeks trial by jury, compensatory, statutory and special damages, plus interest, penalties, attorney fess, court costs and all other just and proper relief. She is represented by attorney Lenden Webb of Webb Law Group APC in Fresno.
