Fitness instructor accuses training center of wrongful termination

FRESNO — A Fresno County fitness instructor is suing a training center, alleging retaliation and wrongful termination.

Laura Mercado filed a complaint June 23 in Fresno County Superior Court against Central Valley Training Center and Does 1-50, alleging they violated the California Labor Code.

According to the complaint, on Aug. 23, 2016, Mercado was terminated from her employment, leading to monetary damages, lost wages, plus the loss of other employment benefits, pecuniary benefits and emotional distress. The suit says Mercado was terminated for reporting abuse of elderly clients. 

The plaintiff alleges the defendants retaliated against her by terminating her employment for refusing to engage in an illegal activity.

Mercado seeks trial by jury, reinstatement, compensatory, special and punitive damages, attorney fees and court costs, plus all relief the court deems proper. She is represented by attorneys Michael J.F. Smith and John L. Migliazzo of Michael J. F. Smith, A Professional Corporation in Fresno.
