Couple accuses swimming pool company of failure to complete work

FRESNO — A Fresno County couple is suing a swimming pool company, alleging breach of contract.

Herb Wingfield and Tammy Wingfield of Selma, California, filed a complaint Feb. 14 in Fresno County Superior Court against Pools by Waterston Inc., Robert Waterston, Does 1-25, alleging they failed to complete the swimming pool project they agreed to do for the plaintiffs for a cost of $54,000.

According to the complaint, the Wingfields suffered monetary damages as the result of having their pool work being left incomplete at 1474 Nelson Blvd. The plaintiffs allege the defendants failed to complete the construction of the pool on their property as agreed upon in the contract.

The Wingfields seeks compensatory damages, punitive damages, all legal fees and all other relief the court deems just. They are represented by attorney David M. Gilmore of Gilmore Magness Leifer in Fresno.
