Security guard alleges violation of wage laws

SAN JOSE — A Santa Clara man is suing a California business, alleging unpaid wages, violation of applicable minimum wage law, violation of workers compensation acts and wrongful termination.

Gary Badertscher filed a complaint July 20 in U.S. District Court for the Northern District of California San Jose Division against Opsec Executive Protection, Opsec Executive Protection LLC, Renand Garcia, Peter Phong and Ronnie Lim, alleging they failed to pay fair wages to the plaintiff, violation the Fair Labor Standards Act.

According to the complaint, Badertscher suffered monetary damages from not being paid all wages earned as a security guard. The plaintiff alleges the defendants retaliated against him and failed to provide his requested files.

Badertscher seeks unpaid wages, compensatory damages, liquidated damages, interest, civil penalties equal to $50 for the initial violation and $100 for each subsequent violation not to exceed $4,000, a statutory penalty of $10,000, all legal fees and any other relief the court deems just. He is represented by attorney Huy Tran of Justice at Work Law Group, LLP in San Jose.
