Disabled client alleges North American Life violated ERISA

LOS ANGELES — A disabled client is suing North American Life, alleging breach of contract.

Philip Rossiello filed a complaint July 17 in U.S. District Court for the Central District of California against Life Insurance Company of North America, alleging denial of the plaintiff's claim for disability benefits.

According to the complaint, Rossiello became disabled due to injuries to his spine. The suit says he applied for disability benefits but was denied. The plaintiff alleges the defendant upheld its decision to deny benefits despite the terms of Rossiello's insurance plan.

Rossiello seeks benefits due, all legal fees and all other relief the court deems just. He is represented by attorneys Frank N. Darras, Susan B. Grabarsky and Phillip S. Bather of Darras Law in Ontario, California .
