Employee accuses Union Pacific of negligence

SACRAMENTO — An employee is suing Union Pacific, alleging a hostile work environment and negligence.

Kevin Barnes filed a complaint July 27 in U.S. District Court for the Eastern District of California against Union Pacific Railroad Company, alleging failure to provide a reasonably safe working environment.

According to the complaint, Barnes, who worked for Union Pacific from 1995 to 2014, suffered physical pain due to musculoskeletal and/or nervous system disorders including injuries to his back and neck. The plaintiff alleges Union Pacific failed to warn Barnes plaintiff of being exposed to ergonomic risk factors during his employment.

Barnes seeks trial by jury, all medical expenses, damages, legal fees, interest and any other relief the court deems just. He is represented by attorney Jeff R. Dingwall of Eight & Sand in San Diego.
