Labor group accuses insulation business of violating ERISA

SAN FRANCISCO — A labor group is suing an insulation contractor, alleging breach of contract.

Western States Insulators and Allied Workers Pension Plan; Western States Insulators and Allied Workers Health Plan, Western States Insulators and Allied Workers Individual Account Plan, Board of Trustees for the Western States Insulators and Allied Workers Pension Plan, Board of Trustees for the Western States Insulators and Allied Workers Health Plan, and Board of Trustees for the Western States Insulators and Allied Workers Individual Account Plan filed a complaint Aug. 4 in U.S. District Court for the Northern District of California against Frontier, Inc. alleging failure to make its monthly contribution to the plaintiffs.

According to the complaint, the plaintiffs suffered monetary damages due to unpaid and late paid contributions by Fronteir. The plaintiffs allege Frontier breached its bargaining agreement by failing to pay the employees' contributions.

The plaintiffs seek injunction against the defendant, order the defendant to make payments due, legal fees, liquidated damages, and all other relief the court deems just. They are represented by attorney Michael Bedolla of Kraw Law Group in Mountain View, California.
