Employee alleges plan administrator violated ERISA

SACRAMENTO — A Sacramento County woman is suing a plan administrator, alleging breach of contract and violation of the Employee Retirement Income Security Act.

Marie Rutledge filed a complaint July 31 in U.S. District Court for the Eastern District of California against Health Net Short Term Disability Plan, Sedgwick CMS, Health Net Long Term Disability Plan, Cigna, Health Net Inc., and Does 1 through 10, alleging they denied the plaintiff's legitimate claim for disability benefits.

According to the complaint, in October 2015, Rutledge became disabled and applied for disability benefits. The suit says he application was denied. 

The plaintiff alleges the defendants wrongly upheld their decision to deny Rutledge's claim for long term disability benefits despite her appeal.

Rutledge seeks all benefits due, interest, legal fees and all other relief the court deems just. She is represented by attorney Paul A. Fleishman of The Fleishman Law Firm in Woodland Hills. California.
