Ex-employee alleges insurance firm violated ERISA

SAN FRANCISCO — A California woman is suing Lincoln National Life, alleging breach of contract.

Kijoo Kim filed a complaint Aug. 9 in U.S. District Court for the Northern District of California against The Lincoln National Life Insurance Company, alleging the defendant wrongfully denied the plaintiff's claim for disability benefits, violating the Employee Retirement Income Security Act.

According to the complaint, Kim became disabled in 2013 due to a prolonged sickness and other acute and chronic medical problems while working for Connor & Bishop. The suit said Kim was initially approved to receive disability benefits until they terminated in May 2015. The plaintiff alleges Lincoln National wrongfully terminated Kim's disability benefits based on its claim that she is no longer disabled.

Kim seeks pay disability benefits due, reinstatement, legal fees, interest, and all other relief the court deems just. She is represented by attorney Scott Kalkin of Roboostoff & Kalkin in San Francisco.
