Customer alleges North American Life violated ERISA

SACRAMENTO — A Sacramento County woman is suing North American Life, alleging breach of contract an violating the Employee Retirement Income Security Act.

Sherry Dulaney of Elk Grove filed a complaint Aug. 18 in U.S. District Court for the Eastern District of California against John Muir Health Disability Benefits Plan, Life Insurance Company of North America, alleging they wrongfully denied the plaintiff's claim for disability benefits.

According to the complaint, Dulaney suffered damages from having her disability benefits denied despite her having developed carpal tunnel and cubital syndrome in January 2013. The plaintiff alleges the defendants wrongfully upheld their decision to deny Dulaney's disability benefits despite having sufficient evidence of her disability.

Dulaney seeks pay disability benefits, all other consequent rights and privileges, legal fees, interest and all other relief the court deems just. She is represented by attorney Jesse S. Kaplan of Carmichael, California.
