Mobile app business accused of violating phone privacy law

SAN FRANCISCO — A Colorado man filed a class action complaint against a California mobile app business, alleging violation of the Telephone Consumer Protection Act.

Daniel DeClements filed a complaint, individually and on behalf of all others similarly situated, Aug. 24 in U.S. District Court for the Northern District of California against TangoMe Inc of Mountain View, California. alleging the defendant illegally sent several text messages to the plaintiff's cellular telephone.

According to the complaint, DeClements suffered damages from receiving several unwanted text messages on his cell phone. The plaintiff alleges TangoMe illegally used an automatic telephone dialing system to send unwanted text messages to DeClements.

DeClements seeks trial by jury, monetary damages of a minimum of $500 for each violation, disgorgement, injunction, interest, legal fees, treble damages and any other relief the court deems just. He is represented by attorney Steven L. Weinstein of Oakland.
