LOS ANGELES — Pipe trade labor groups are suing an Arizona construction company, alleging breach of contract and violation of the Employee Retirement Income Security Act.
Trustees of the Southern California Pipe Trades Health and Welfare Trust Fund, Trustees of the Southern California Pipe Trades Retirement Trust Fund, Trustees of the Southern California Pipe Trades Defined Contribution Trust Fund, Trustees of the Southern California Pipe Trades Vacation and Holiday Trust Fund, Trustees of the Southern California Pipe Trades Christmas Bonus Fund, Trustees of the Apprentice and Journeyman Training Trust Fund, Trustees of the Southern California Pipe Trades Pensioners and Surviving Spouses Health Fund, Trustees of the Plumbers and Pipefitters National Pension Fund and Trustees of the International Training Fund filed a complaint Aug. 21 in U.S. District Court for the Central District of California against NPL Construction Co. and Does 1-100, alleging they failed to make their monthly contribution to the plaintiffs and owe more than $840,000.
According to the complaint, the plaintiffs suffered monetary damages due to unpaid and late paid contributions. The plaintiffs allege the defendants breached their bargaining agreement by failing to remit their employees' monthly contribution.
The plaintiffs seek an unpaid fringe benefit contribution of $843,834.64, liquidated damages, late fees, interest, exemplary and punitive damages, audit costs, all legal fees, and all other relief the court deems just.
