Policy holder alleges Prudential violated ERISA

LOS ANGELES — A policy holder is suing Prudential Insurance, alleging breach of contract and violation of the Employment Retirement Income Security Act.

Jessica Huerta filed a complaint Aug. 23 in U.S. District Court for the Central District of California against The Prudential Insurance Company of America and Assa Abloy Inc. Long-Term Disability Plan, alleging they wrongfully denied the plaintiff's claim for disability benefits.

According to the complaint, Huerta became disabled in July 2015 due to scleroderma and a degenerative joint disease. The suit says she applied for disability benefits but was denied. 

The plaintiff alleges the defendants upheld their decision to her claim for benefits despite her still being disabled according to the plan.

Huerta seeks benefits not paid, plus interest, other benefits, legal fees and any other relief the court deems just. She is represented by attorneys Frank N. Darras, Susan B. Grabarsky and Phillip S. Bather of Darras Law in Ontario, California.
