Customer accuses Ford of warranty breach

SACRAMENTO— A California man is suing Ford, alleging breach of warranty, design defect and negligence.

Herbert Dyer of Inyo County filed a complaint Aug. 31 in U.S. District Court for the Eastern District of California against Ford Motor Company and Does 1 through 75, alleging they manufactured and sold a defective vehicle to the plaintiff.

According to the complaint, Dyer suffered monetary damages from purchasing a 2012 Ford Focus on May 31, 2012, for $26.070 that had a defective powertrain. The plaintiff alleges Ford failed to fix the defective powertrain on the Ford Focus.

Dyer seeks trial by jury, damages, restitution and rescission, incidental and consequential damages, statutory damages, interest, legal fees and all other relief the court deems just. He is represented by attorneys Hallen D. Rosner, Jeffrey L. Le Pere and David L. Herman of Rosner, Barry & Babbitt LLP in San Diego.
