Debt collector accused of violating FDCPA

SACRAMENTO — A Kern County woman is suing a debt collector, alleging misrepresentation and violating of the Fair Debt Collection Practices Act.

Maria Molina filed a complaint Aug. 28 in U.S. District Court for the Eastern District of California against D. Scott Carruthers PLC, and SFM-6 LLC, alleging they wrongfully called the plaintiff in an attempt to collect an alleged debt.

According to the complaint, in 2017, Molina has suffered damages from having funds transferred from her account. The plaintiff alleges the defendants allegedly initiated an automatic fund transfer without plaintiff's authorization.

The plaintiff requests a trial by jury and seeks statutory damages in the amount of $1,000, actual damages, all legal fees, interest and any other relief as this court deems just. She is represented by Elliot Rosenberger and Joshua Biletsky of Biletsky Rosenberger in Los Angeles.
