9 employees allege baking company failed to pay proper wages

SAN JOSE — Nine employees are suing a baking business, alleging unpaid wages and violation of workers compensation acts.

Fernando Ramirez, Ivan Bundy, Norman Suhovy, Michael Hummel, Jerry Loyd, Henry Kittrell, Francisco Trovao, Daniel Shilling, and Heraldo Velasquez filed a complaint Sept. 1 in U.S. District Court for the Northern District of California San Jose Division against Flowers Foods Inc., Flowers Baking Co. of California and Flowers Baking Co. of Modesto, and Flowers Bakeries Brands Inc., alleging they failed to pay fair wages to the plaintiffs, violating the Fair Labor Standards Act.

According to the complaint, the plaintiffs suffered monetary damages from not being paid any overtime wages when they worked more than 40 hours per week. The plaintiffs allege the defendants failed to provide adequate rest periods and or provide accurate wage statements.

The plaintiffs seek trial by jury, compensation, payment of wages, overtime compensation, damages, wages, statutory penalties, restitution, legal fees and all other relief the court deems just. They are represented by attorneys Peter Rukin and Valerie Brender of Rukin Hyland LLP in San Francisco.
