Fire service technician alleges employer failed to pay proper overtime

SAN JOSE — A San Jose man has filed a class action lawsuit against his employer, alleging unpaid wages and violation of workers compensation acts.

Mark Cassingham filed a complaint, individually and on behalf of all others similarly situated, Aug. 29 in U.S. District Court for the Northern District of California San Jose Division against Cintas Corporate Services Inc., alleging the employer failed to pay fair wages, violating the Fair Labor Standards Act.

According to the complaint, Cassingham worked for more than 40 hours as a fire service technician between Jan. 29, 2016, and May 19, 2017, without being paid proper overtime wages. The plaintiff alleges Cintas is violating FLSA by failing to pay a minimum of time and half for all hours worked in excess of 40 per week.

Cassingham seeks trial by jury, payment of overtime wages, minimum wages, damages, liquidated damages, restitution, statutory damages, interest, all legal fees, and all other relief the court deems just. He is represented by attorneys Kevin J. Stoops and Charles R. Ash IV of Sommers Schwartz PC in Southfield, Michigan, and by Jahan C. Sagafi of Outten & Golden LLP in San Francisco.
