Roofers labor group alleges employer violated ERISA

SAN JOSE — A roofers labor group is suing employers, alleging breach of contract and violation of the Employee Retirement Income Security Act.

Bay Area Roofers Health & Welfare Trust Fund, Pacific Coast Roofers Pension Plan, East Bay/ North Bay Roofers Vacation Trust Fund, Bay Area Counties Roofing Industry Promotion Fund, Bay Area Counties Roofing Industry Apprenticeship Training Fund, Doug Ziegler, as trustee of the plaintiffs, Robert Rios, as trustee of the Bay Area Roofers Health & Welfare Trust Fund and the Pacific Coast Roofers Pension Plan filed a complaint Aug. 28 in U.S. District Court for the Northern District of California San Jose Division against Petersen-Dean, Inc. doing business as Petersendean, and Petersen-Dean Commercial Inc., doing business as Roofs4America, alleging the defendants failed to pay their monthly contribution to the plaintiffs.

According to the complaint, the plaintiffs suffered monetary damages due to unpaid and late paid contributions. The plaintiffs allege the defendants breached their bargaining agreement by failing to remit their employees' contributions.

The plaintiffs seek unpaid contributions, liquidated damages, interest, all legal fees and all other relief the court deems just. They are represented by attorney Wan Yan Ling of Neyhart, Anderson, Flynn & Grosboll in San Francisco.
