LOS ANGELES — A Los Angeles County woman is suing Cigna Life, alleging breach of contract and violation of the Employee Retirement Income Security Act.
Lea Wagenstein filed a complaint Aug. 29 in U.S. District Court for the Central District of California against Cigna Life Insurance Company and Does 1 through 10, alleging they wrongfully denied the plaintiff's claim for disability benefits.
According to the complaint, Wagenstein, who worked for Fox Entertainment Group, became disabled. The suit says she originally was eligible to receive disability benefits but was then denied.
The plaintiff alleges Cigna Life failed and refused to pay benefits to Wagenstein despite her being eligible to receive benefits based on terms of the plan.
Wagenstein seeks all benefits due, plus 10 percent interest, legal fees and all other relief the court deems just. She is represented by attorneys Charles J. Fleishman and Paul A. Fleishman of The Fleishman Law Firm in Woodland Hills, California
