Individual sues Life Insurance Company of North America

LOS ANGELES — A policy holder is suing North America Life, alleging breach of contract in violating the Employee Retirement Income Security Act.

Gracy Daniel filed a complaint Aug. 31 in U.S. District Court for the Central District of California against Life Insurance Company of North America, the insurance firm wrongfully denied the plaintiff's claim for disability benefits.

According to the complaint, Daniel became disabled due to several health issues including pain in her neck, shoulder, lower back and hip areas. The suit says she applied for disability benefits but was denied. 

The plaintiff alleges North America Life wrongfully upheld its decision to deny Daniel's claim for benefits despite having sufficient medical proof of her disability.

Daniel seeks benefits due, plus interest, legal fees and all other relief the court deems just. She is represented by attorney Phillip S. Bather of DarrasLaw in Ontario, California.
