Debt collector accused of violating phone privacy laws

LOS ANGELES — A Los Angeles County man is suing a California debt collector, alleging violation of telephone harassment statutes.

Nicholas Conner of Hermosa Beach, California, filed a complaint Sept. 5 in U.S. District Court for the Central District of California against Rash Curtis & Associates, alleging the defendant illegally called the plaintiff several times in an attempt to collect an alleged debt, violating the Telephone Consumer Protection Act.

According to the complaint, in November 2016, Conner suffered damages from receiving several illegal collection calls. The plaintiff alleges Rash Curtis kept calling his cellular telephone despite Conner's request to stop.

Conner seeks trial by jury, statutory damages of $500 for each negligent violation, injunctive relief, statutory treble damages of $1,500, statutory damages of up to $1,000, legal fees and all other relief the court deems just. He is represented by attorneys Joshua B. Swigart of Hyde & Swigart in San Diego, and by Abbas Kazerounian of Kazerouni Law Group, APC in Costa Mesa, California.
