Employee accuses health care staffing business of failing to pay proper wages

SACRAMENTO — A California man has filed a class action lawsuit against a health care staffing business, alleging unpaid wages and violation of workers compensation acts.

Bryon Dittman filed a complaint, individually and on behalf of others similarly situated, Sept. 6 in U.S. District Court for the Eastern District of California against Medical Solutions LLC and Does 1 to 10, alleging they failed to pay fair wages to the plaintiff, violating the Fair Labor Standards Act.

According to the complaint, Dittman worked for more than 40 hours per week without being paid any overtime wages. The plaintiff alleges the defendants failed to pay the overtime premium to Dittmann for hours worked that exceeds 40 hours per week as required by FLSA.

Dittman seeks trial by jury, unpaid overtime wages, general and special damages, interest, restitution, legal fees and all other relief the court deems just. He is represented by attorneys Matthew B. Hayes and Kye D. Pawlenko of Hayes Pawlenko LLP in Pasadena.
