Pharmaceutical worker accuses Liberty Life of violating ERISA

SACRAMENTO — A Kern County woman is suing Liberty Life Assurance Company of Boston and Takeda Pharmaceuticals USA Inc. Long Term Disability Plan, insurance firm, citing alleged breach of contract.

Kimberly Whitehead filed a complaint Sept. 7 in U.S. District Court for the Eastern District of California against Liberty Life Assurance Company of Boston and Takeda Pharmaceuticals USA Inc. Long Term Disability Plan, alleging they wrongfully denied the plaintiff's claim for disability benefits in violation of the Employee Retirement Income Security Act.

According to the complaint, in 2016, Whitehead, who worked for Takdea Pharmaceuticals, became disabled. The suit says she applied for long-term disability benefits but was denied. 

The plaintiff alleges the defendants wrongfully failed and refused to pay long-term disability benefits to her.

Whitehead seeks payment of disability benefits, all legal fees, interest and all other relief the court deems just. She is represented by attorney Glenn R. Kantor of Kantor & Kantor LLO in Northridge, California.
