LOS ANGELES — A Los Angeles County man is suing Lincoln Insurance, alleging breach of contract and violation of the Employee Retirement Income Security Act.
George Kos filed a complaint Sept. 7 in U.S. District Court for the Central District of California against The Lincoln National Life Insurance Company and Group Long Term Disability Insurance for employees of NMB (USA) Inc., alleging the insurance firm wrongfully denied the plaintiff's claim for disability benefits.
According to the complaint, Kos became disabled in late 2013. The suit says he applied for disability benefits but was denied. The plaintiff alleges the defendants failed and refused to pay his disability benefits despite Kos being considered disabled according to the terms of the plan.
Kos seeks payment of disability benefits, reinstatement, all legal fees, interest and all other relief the court deems just. He is represented by attorney Michell O. Hefter of Kantor & Kantor LLP in Northridge, California.
