LOS ANGELES — An iron workers group is suing a California construction business, alleging breach of contract and violation of the Employee Retirement Income Security Act.
The Board of Trustees of the California Ironworkers Field Pension Trust, the Board of trustees of the California Ironworkers Field Welfare Plan, the Board of Trustees of the California Field Ironworkers Vacation Trust Fund, the Board of Trustees of the California Field Ironworkers Apprenticeship Training and Journeyman Restraining Fund, the Board of Trustees of the California and Vicinity Field Iron Workers Annuity Trust Fund, the Board of Trustees of the California Field Iron Workers Administrative Trust, the Board of Trustees of the California Field Iron Workers Labor Management Cooperative Trust Fund, the Board of Trustees of the Ironworkers Workers Compensation Trust, and Board of Trustees of the Ironworker Management Progressive Action filed a complaint Sept. 7 in U.S. District Court for the Central District of California against Flores Steel Construction of Hemet, California, alleging the defendant failed to make its monthly contribution to the plaintiffs.
According to the complaint, the plaintiffs suffered monetary damages as the result of the unpaid contributions. The plaintiffs allege Flores Steel Construction breached their bargaining agreement by failing to make the employees' contribution.
The plaintiffs seek unpaid contributions of at least $300,098.66, liquidated damages of at least $60,984.28, interest of $4,496.11, audit expenses, legal fees and all other relief the court deems just. They are represented by attorneys Kerry K. Fennelly and Valentina S. Mindirgasova of Cornwell & Baldwin in Escondido.
