Consumer alleges health care plan manager violated phone privacy statutes

SAN FRANCISCO — An Illinois man has filed a class action lawsuit against an Oakland health plan manager, alleging violation of telephone harassment statutes.

John F. Shonkwiler of Cook County, Illinois filed a complaint, individually and on behalf of all others similarly situated, Sept. 12 in U.S. District Court for the Northern District of California against Kaiser Foundation Health Plan Inc., alleging the defendant illegally called the plaintiff several times to market its products and services, violating the Telephone Consumer Privacy Act.

According to the complaint, in June 2017, he suffered damages from receiving several unsolicited calls to the his telephone. The plaintiff alleges Kaiser kept calling him using a prerecorded or artificial message despite his request for the defendant to stop.

Shonkwiler seeks trial by jury, actual or statutory damages of at least $500, require the defendant to cease all call activities to the plaintiff, legal fees and all other relief the court deems just. He is represented by attorneys Gene J. Stonebarger and Richard D. Lambert of Stonebarger Law APC in Folsom, California.
