Consumer accuses debt collector of unfair practices

LOS ANGELES — A California woman is suing debt collectors, alleging abusive debt collection practices.

Ervie Cuasim of Ventura, California, filed a complaint Feb. 5 in U.S. District Court for the Central District of California against Cuzco Capital Investment Management LLC, Regency One Capital et al, alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, on Jan. 30, 2017, Cuasim began receiving calls from the defendants attempting to collect an alleged debt. Due to the defendants' unlawful conducts, the suit says, Cuasim was abused, embarrassed, emotionally distressed and oppressed. 

The plaintiff alleges the defendants failed to disclose that they are debt collectors, failed to provide the requisite debt validation information and continued to contact her after having knowledge that she was being represented by an attorney.

Cuasim seeks trial by jury, statutory damages of $1,000, actual damages of $5,000, legal fees of $3,355, prejudgment interest, court costs and all other relief the court deems proper. She is represented by attorney Robert Amador of Centennial Law Offices in Ventura.
