LOS ANGELES – An aerial photographer alleges his photos were used without permission by a San Diego business.

Craig Schmitman filed a complaint on May 18 in the U.S. District Court for the Central District of California against Marv Golden Discount Sales Inc., et al. alleging copyright infringement.

According to the complaint, the plaintiff alleges that he is the owner of aerial photographs published in the internet website aeronauticpictures.com. He alleges that beginning in October 2017, the defendants downloaded or copied his photographs and used them on various websites. He alleges the defendants intentionally removed his copyright management information from the photographs and failed to properly attribute copyright to him.

The plaintiff holds Marv Golden Discount Sales Inc., et al responsible because the defendants allegedly downloaded and/or copied plaintiff's copyrighted images without his consent or authority.

The plaintiff requests a trial by jury and seeks actual damages, statutory damages, punitive damages, interest, attorneys' fees and costs and such other and further relief. He is represented by Eric D. Ridley of Law Offices of Eric D. Ridley in Port Hueneme.
