Wilmington Fuel Gas Station alleged to not have reserved parking spaces for customers with disabilties

LOS ANGELES – A Wilmington gas station is alleged to have barriers that restrict access to customers with disabilities.

Daniel Lopez filed a complaint on June 4 in the U.S. District Court for the Central District of California against Gail Holtzman, in individual and representative capacity as trustee of The Gail Holtzman Revocable Trust, et al. alleging violation of the Americans with Disabilities Act and the Unruh Civil Rights Act.

According to the complaint, the plaintiff is a paraplegic who cannot walk and uses a wheelchair. He alleges that between March and April 2018, he went to defendants' Wilmington Fuel Gas Station and found that none of the parking spaces were marked and reserved for persons with disabilities.

The plaintiff holds the defendants responsible because the defendants allegedly failed to mark and reserve parking space for persons with disabilities and failed to provide transaction counter lower than 36 inches.

The plaintiff seeks injunctive relief, compelling defendants to comply with the Americans with Disabilities Act and the Unruh Civil Rights Act, actual damages and a statutory minimum of $4,000, attorney fees, litigation expenses and costs. He is represented by Chris Carson, Raymond Ballister Jr., Phyl Grace and Dennis Price of Center for Disability Access in San Diego.
