Woman alleges Nevada County Courthouse has barriers to disabled individuals

SAN FRANCISCO – A disabled Grass Valley woman alleges the Nevada County Courthouse and Annex has access barriers and discriminatory policies that denied her full and equal access to the facility.

Carol Ann Wilshusen filed a complaint on June 24 in the U.S. District Court for the Eastern District of California against Superior Court of California, County of Nevada and Does 1-10 alleging that they violated Title II of the Americans With Disabilities Act and the Unruh Civil Rights Act.

According to the complaint, the plaintiff alleges that between Sept. 18, 2017, and Feb. 22, 2018, she visited defendants' courthouse and alleges the property does not have complaint accessible parking spaces.

The plaintiff holds Superior Court of California, County of Nevada and Does 1-10 responsible because the defendants allegedly failed to design, construct and/or alter the parking facilities at the courthouse so that they are readily accessible and usable by patrons with disabilities.

The plaintiff requests a trial by jury and seeks an order requiring defendants to take steps necessary to bring the courthouse's facilities into compliance with ADA standards, award for all damages, litigation costs, fees and expenses and such just and proper relief. She is represented by Chris Carson, Phyl Grace, Dennis Price, Khushpreet Mehton and Mary Melton of Center for Disability Access in San Diego.
