FRESNO – A Clovis resident alleges that a contractor hired for a project failed to construct the project in a manner free of defects.

Henry Mata filed a complaint on June 20 in the Fresno County Superior Court against Johnston Contracting Inc., All West Construction, et al. alleging breach of written contract and other counts.

According to the complaint, the plaintiff alleges that on Oct. 11, 2006, the plaintiff and Johnston entered into an agreement in exchange for $3.4 million to construct Precision Plastics at Portal Sierra II in Clovis. The plaintiff alleges that in April 2015, he noticed cracking in the exterior walls of the project.

The plaintiff holds Johnston Contracting Inc., All West Construction, et al. responsible because the defendants allegedly failed to perform the contracted work in a good and workmanlike manner.

The plaintiff seeks damages in an amount according to proof, plus prejudgment interest, costs of suit and such other just and proper relief. He is represented by Scott D. Lair and Marisa L. Balch of Wanger Jones Helsley PC in Fresno.
