LOS ANGELES – An insurance broker is alleged to have misclassified some employees to avoid paying overtime wages.

Pamela Rubin-Knudsen, individually and on behalf of all others similarly situated, filed a complaint on July 18 in the U.S. District Court for the Central District of California against Arthur J. Gallagher & Co. and Arthur J. Gallagher Service Co. LLC citing California labor code.

According to the complaint, the plaintiff was hired by the defendants in May 2016 as a client service manager senior. She alleges her position was misclassified as exempt from receiving overtime pay.

The plaintiff holds Arthur J. Gallagher & Co. and Arthur J. Gallagher Service Co. LLC responsible because the defendants allegedly misclassified them as exempt employees to avoid paying overtime compensation, failed to provide off-duty meal periods and failed to pay wages due after termination.

The plaintiff requests a trial by jury and seeks an order certifying this action as a class action and appointing plaintiff and her counsel as representatives, award of unpaid wages, actual or statutory damages, with interest, fees and costs and such other just and proper relief. She is represented by Jason M. Frank and Scott M. Sims of Frank Sims & Stolper LLP in Irvine.
