Harley-Davidson Credit alleged to have called Oceanside man at harassing rate

SAN DIEGO – An Oceanside consumer alleges a Chicago, Illinois-headquartered debt collector called him at an excessive and harassing rate.

Randy Tay filed a complaint on July 30 in the U.S. District Court for the Southern District of California against Harley-Davidson Credit Corp. alleging that the debt collector repeatedly violated the Telephone Consumer Protection Act and the Rosenthal Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges the defendant called him through the use of an automatic telephone dialing system to collect an alleged debt. He alleges in February, he asked the defendant to stop calling him but the defendant ignored this request.

The plaintiff holds Harley-Davidson Credit Corp. responsible because the defendant allegedly called him without his consent.

The plaintiff requests a trial by jury and seeks statutory damages of $500 for each violation and $1,000 for each and every willful violation, costs of litigation, attorneys’ fees and such other and further relief as may be just and proper. He is represented by Trinette G. Kent of Lemberg Law LLC in Phoenix, Arizona.
