SAN DIEGO – An Exelis Inc. employee alleges an insurance company has wrongfully denied disability benefits to him.
Christopher Wheeler filed a complaint on Aug. 2 in the U.S. District Court for the Southern District of California against Metropolitan Life Insurance Co. alleging violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that on March 17, 2015, he was a participating employee in a plan sponsored by Exelis Inc. when he became disabled. The suit states effective in or about Jan. 9, 2016, his claim for long-term disability benefits was denied by the defendant.
The plaintiff holds Metropolitan Life Insurance Co. responsible because the defendant allegedly breached its fiduciary duties by wrongfully denying his benefits.
The plaintiff seeks unpaid plan benefits, interest, attorneys’ fees, costs and such other proper and just relief. He is represented by John P. Stennett and Barbara A. Casino of Stennett & Casino in San Diego.
