Richman Property Services employee alleges Aetna wrongfully denied disability benefits

LOS ANGELES – A Ventura County woman alleges that her claim and appeal for long-term disability benefits was wrongfully denied.

Tammy Gregory filed a complaint on Aug. 17 in the U.S. District Court for the Central District of California against Aetna Life Insurance Co. and Richman Property Services Inc. Long Term Disability Plan alleging that they violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff is an employee of Richman Property Services and participates in its employee welfare benefit plan. She alleges that she became disabled under the terms of the plan and filed a claim with Aetna for long-term disability benefits in February. The suit states Aetna denied her claim and appeal.

The plaintiff holds Aetna Life Insurance Co. and Richman Property Services Inc. Long Term Disability Plan responsible because Aetna allegedly denied her claim for disability benefits without providing a prompt and reasonable explanation and without conducting adequate investigation.

The plaintiff seeks payment of disability benefits, all costs and attorneys’ fees, pre- and post-judgment interest and such other just and proper relief. She is represented by Andrew M. Kantor and Glenn R. Kantor of Kantor & Kantor LLP in Northridge.
