Consumer files suit against Midland Credit Management, Midland Funding over contents of collection letter

LOS ANGELES – A Los Angeles County consumer alleges two debt collectors sent her letters that used illegal collection practices.

Rina A. Mejia filed a complaint on Aug. 24 in the U.S. District Court for the Central District of California against Midland Credit Management Inc. and Midland Funding LLC alleging violation of the Rosenthal Fair Debt Collection Practices Act and the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that on April 25 and July 26, she received collection letters from the defendants regarding an alleged debt. She alleges she was damaged because of the illegal collection and intimidation tactics used by the defendants in the letter.

The plaintiff holds Midland Credit Management Inc. and Midland Funding LLC responsible because the defendants allegedly threatened to her assign her debt to an attorney with false representation that the action would result in unstoppable litigation.

The plaintiff requests a trial by jury and seeks actual and damages, attorney’s fees, costs and such other just and proper relief. She is represented by Michael F. Cardoza of The Cardoza Law Corp. in San Francisco.
