LOS ANGELES – A consumer alleges inaccuracies to her credit report have caused her financial and dignitary harm.
Andrea Anthonis-Smith filed a complaint on Aug. 24 in the U.S. District Court for the Central District of California against Ford Motor Credit Co. LLC, Equifax Information Services LLC, and Experian Information Solutions Inc. alleging that they violated the Federal Fair Credit Reporting Act, the Rosenthal Fair Debt Collection Practices Act and the California Consumer Credit Reporting Agencies Act.
According to the complaint, the plaintiff purchased a Lincoln vehicle in March 2013 and secured financing through a wholly owned subsidiary of Ford Motor Credit. She was unable to continue making payments in January 2016 and Ford charged off the loan in April 2016 at an amount of $1,959.
The plaintiff alleges that in January, she noticed her account has a balance was $2,971, an amount greater than previously reported and disputed the amount.
The plaintiff holds Ford Motor Credit Co. LLC, Equifax Information Services LLC and Experian Information Solutions Inc. responsible because the defendants failed to investigate her disputes.
The plaintiff requests a trial by jury and seeks actual, punitive and statutory damages, with interest, costs and attorney’s fees and such other just and proper relief. She is represented by Brian Brazier of Price Law Group APC in Scottsdale, Arizona.
