Lawsuit: Bakersville drinking water contaminated by area chemical manufacturers

SAN FRANCISCO - The North Kranenburg Water System Mutual Water Company sued a plethora of defendants for multiple charges that include nuisance, trespass and negligence, in a lawsuit filed on Feb. 16 in the San Francisco County Superior Court.

The plaintiff provides drinking water to the Bakersville area. 

The complete list of defendants includes: the Dow Chemical Company, Shell Oil Company/Shell Chemical Company, Occidental Chemical Corporation, Wilbur-Ellis company LLC, J.R. Simplot Company, FMC Corporation, Puregro Company, Nutrien Ag Solutions Inc., Southern Valley Chemical Company, Trical Inc. and 300 unidentified individuals or corporations that could have contributed to the matter of the case. 

According to the lawsuit, the plaintiff's water supply wells are contaminated with trichloropropane (TCP), a highly toxic substance used in certain chemical products. Recently, products containing TCP were discharged, disposed of, applied or released near the Bakersville drinking water supply wells. The plaintiff says that the chemical has absorbed into the groundwater and now contaminates the water supply. 

The defendants in the case are various manufacturers, distributors and releasers of products known to contain the TCP chemical. 

Judgment equivalent to compensatory and exemplary damages is requested. The plaintiff is represented by John Fiske of Baron and Budd, PC, in San Diego.
