Over $20 million demanded from Mather VA hospital by man who was injured in operation

SACRAMENTO - The Sacramento Veterans Affairs Medical Center in Mather (VAMC) faces medical malpractice allegations from a Stanislaus County couple after the husband allegedly sustained permanent neck damage from an operation.

According to documents filed in federal court on March 5, plaintiff Timothy Jason Dynes visited the VAMC for a surgical operation on his ear that was supposed to take approximately 2.5 hours; however, the operation lasted roughly seven hours, the suit said, and Dynes' head was kept in a fixed position turned to the right the entire time.

The plaintiff says that he suffered permanent damage to his neck tissues, muscles and nerves, as well as damage to his left arm and shoulder, as a result of being kept in the position for so long.

Dynes demands $10 million for his injuries in his first charge of medical malpractice against the VAMC/the United States, an additional $10 million for his second charge of failure to obtain informed consent, and at least $1 million in damages for loss of consortium from his wife, Danielle. 

The plaintiffs are represented by the Law Office of Jeanne Anne Steffin of Lake Forest and Rappaport, Glass, Levine and Zullo LLP of Islandia, New York.
