Furniture line sold in California alleged to be in violation of Proposition 65

SAN FRANCISCO - Marc Daniel Enterprises Inc. is accused of violating the Safe Drinking Water and Toxic Enforcement Act of 1986, the California legislation that regulates toxins that consumers are exposed to that could cause birth defects, cancer and other medical issues. 

The Act, also known as Proposition 65, states that potentially harmful chemicals and substances in consumer products must be disclosed to the public. The furniture manufacturer is accused of violating Proposition 65 by the plaintiff, the Center for Advanced Public Awareness, in a March 4 lawsuit filed in San Francisco Superior Court.

The plaintiff purchased furniture made by the defendant to test it in a lab, and found presence of di(2-ethylhexyl)phthalate, a toxin that should have been disclosed under the Act, it claims. 

The Center asks the court to ban Marc Daniel from selling the furniture in California without the proper notice, and hold the defendant liable for $2,500 in civil fees for each day that the notice is not provided.
