SACRAMENTO - The City of Sacramento and several city officials are locked in a civil clash in federal court with the Sacramento Homeless Union, the Committee to Recall Darell Steinberg and 30 others.
According to a lawsuit filed on March 24, the City of Sacramento - through its City Attorney defendant Susana Alcala Wood, City Clerk defendant Mindy Cuppy and Assistant Clerk Wendy Klock-Johnson - has been wrongfully preventing the plaintiffs from proceeding in their intent to recall Mayor Darrell Steinberg.
The lawsuit says that the clerk first agreed to meet with the plaintiffs to accept their notice of intention to initiate a recall, but then suddenly canceled the appointment with the plaintiffs and announced that she would not accept the intent.
The city attorney is accused of backing the clerk's wrongful prevention of the filing of the notice, through telling the plaintiffs that the notice would be rejected no matter how they attempted to file.
The other 30 plaintiffs are the signees of the notice of intention to recall.
The defendants are accused of violating First Amendment freedom of speech rights by preventing the recall campaign from beginning.
