GrubHub sued over allegedly not-so-free delivery for plus subscribers

SAN FRANCISCO -- A man claims that GrubHub does not honor its unlimited free delivery for plus subscribers. 

Jesse Stout filed a class action complaint on May 3 in the Superior Court County of San Francisco against GrubHub Inc and Does 1-50.

According to the complaint, in 2020, GrubHub began offering "unlimited free delivery" for GrubHub+ subscribers at a monthly flat rate of $9.99. Stout alleged that GrubHub concealed the true nature of additional delivery fees by calling them "CA Driver Benefits Fee" which GrubHub began charging in December 2020. Stout alleged that GrubHub fails to honor the promise of "unlimited free delivery" but charging the additional hidden fees. 

Stout seeks compensatory and punitive damages, attorney's fees and cost of suit. Stout is represented by Jeffery D. Kalie of Kaliel Gold PLLC.
